Times change, but things have definitely been heading south in Oregon's public forests the past 35 years -- and the predictable beginnings of our nearly-annual catastrophic wildfire events. My thought is that this isn't a "final chapter" so much as just one more step in the wrong direction. Why the schools and taxpayers are just letting this slide is concerning, but it is never too late to change course. The headline is right -- the escalati...Bob Zybach:<br /><br />The headline is right -- the escalating incompetence of our elected officials in managing State forestlands is "unbelievable." This "plan" makes no sense. The Elliott is held in trust for Oregon's school children. And now the State is trying to get out of their legal obligation by borrowing a $100 million to "purchase" an estimated $400 million in assets and then make the children (and their parents) pay it back! Wow. Unbelievable. <br /><br />This editorial only touches the surface of how Oregon's State forestlands have been mismanaged and devalued over the past 30 years by our 3-member State Land Board and our State Board of Forestry. This has been a dream for "sue-and-settle" environmental lawyers and the firms and organizations they represent, and an absolute disaster for our forests, schools, and rural timber-based economies. And our rural families and infrastructures.<br /><br />In December the Governor claimed to be interested in rural Coos and Douglas county jobs and called for "new and innovative solutions" to her failed attempt to sell the Elliott. Wayne Giesy and I submitted a proposal through our 501 c(3) rural nonprofit organization, Oregon Websites & Watersheds Project, Inc., that produced $460 million for our schools over 20 years, created an estimated 430 jobs almost immediately, provided 35,000 acres specific to spotted owl and marbled murrelet habitat, only lasted 20 years, and provided paid research opportunities to OSU at no cost. Our proposal was completely ignored. <br /><br />Instead, all logging has been halted on the Elliott and local Coos and Douglas county employees have been replaced by two Lane County contract "caretakers" while the federal government is given free rein to further fragment the forest through mathematical modeling programs designed to enhance spotted owl and marbled murrelet populations. And they -- not our schools -- are being given more than $6 million to do this.<br /><br />This is truly unbelievable. It is time to upgrade the Board of Forestry to include actual experienced foresters and to replace the State Land Board (established in 1859) with a functional Board of Trustees that will manage our State Lands as intended by law. The question is why, from 1880-1940, did Coos Bay support a huge salmon canning industry? What happened to the murrelets and spotted owls? My reasons involve my father. He had some concern in the matter. He did not work for the contractor nor was he BLM or Forestry. He was a Federal employee and knew the situation well enough to be called as a witness in the trials. I am not aware that it was absolutely established that the fire was started by the "roller" I have watched rollers operate many times over the coarse of my youth. I do not remember ever seeing one "throw off sparks" However, it was apparently established that some piece of equipment OR some careless smoker on the job site started that fire. I assume that John Perry is either extremely elderly or has died. So I am hoping you can help me. How can I gain access to the transcripts of the trials involved. Both the one from Douglas county and Oregon Supreme Court? Are those types of documents available to the general public? I thank you for your time and any assistance you can offer me. As one who was responsible for chronicling the spotted owl debate, I learned first hand what a travesty the so-called science is. I sat through hours of court interrogation of the author of the NW Forest Plan and future Chief of the U.S. Forest Service, Jack Ward Thomas. JWT struggled with answering the scientific credibility questions from timber industry Attorney Mark Rutzick. JWT was extremely frustrated by Rutzick’s repeated questions about the spotted owl science and scientific credibly. JWT finally blurted out “Science is credible if other scientists think it is!”<br /><br />JWT was suggesting that a mere attorney was not qualified to question the dependability of scientists. In fact outside a legal setting, JWT let me know that as a mere Forester “You are outta your league, babe” for asking Spotted owl science questions of the former Elk biologist from Northeast Oregon.<br /><br />Dr. Zybach’s paper, in addition to bringing back unpleasant memories, demonstrates that in the 23 years since the Spotted owl was listed under the Endangered Species Act based on the “opinion” of scientists, not actual data regarding the number of owls, their reproductive rate their survival rate, or real measurements of the owl’s actual habitat needs the purported science has only gotten worse. Meanwhile, Spotted owl scientists have failed to verify any of the flimsy assumptions that led to the ESA listing.<br /><br />The listing was followed by economic, social and forest health devastation, as Dr. Zybach described, and is now reaching a public safety crisis where Western Oregon timber counties are prematurely releasing criminals from prison and failing to provide 911 Emergency Service protection.
